**Trigger Warning**
UPDATE: Two out of the five demands that were put forward have been met:
1. 5 policemen have been arrested on the charges of Murder. Madras high court has said there is enough evidence to show that these were custodial deaths.
2. The state government has announced a compensation of Rs 20 lakh for the victim's family. DMK’s Thoothukudi MP Kanimozhi declared a compensation of Rs 25 lakh for the family.
We continue to fight for the following demands to be met:
1. Presence of an impartial doctor at the autopsy
2. Mandatory installation of CCTV surveillance in every police unit across the country.
3. A mandate for all states to invest in sensitivity training programmes for all serving on the force.
UPDATE: CCTV footage from the Thootukudi shop adjacent to Mr. Jayaraj and Mr. Bennix clearly shows that neither of them rolled on the ground as claimed in the FIR lodged by the police against the arrest of these two men. The complaint also mentions this to be the reason for internal injuries. It has become obvious that the police lied, thus making the eyewitnesses’ accounts extremely credible.
Tamil Nadu governor has agreed to transfer this case to the Central Bureau of Investigation (CBI) from the state DGP.
#JusticeForJayarajAndFenix has been trending on social media since June 26, 2020, after two men in the district of Thoothukudi in Tamil Nadu were brutalized and later killed in police custody. Their crime was that they had their mobile shop open 15 minutes past curfew. Many eyewitnesses have accused the police of brutalizing the father and son. Jayaraj’s wife has come forward and lodged a complaint, alleging that police brutality led to their death and that the two officers must be charged with attempt to murder. Apart from being beaten, the two men were showered with curse words and death threats.
Several questions have been raised not just on police brutality but on the judicial magistrate's role in granting custody without conducting the mandated medical check-up. Presently the Madra High court has asked the Superintendent of Police, Thoothukudi, to inquire into the incident and submit a status report.
This is not the first case of police brutality that the country has seen but we can make it the last. Jhatkaa.org has created an email template addressed to the top officials of the Tamil Nadu state asking for immediate action to be taken against the officers who have been identified for this heinous crime and for immediate justice and compensation to be delivered to the bereaved family.

Respected Sir/ Madam,
As a citizen of this country, I am shocked and deeply disturbed to read about the recent police brutality meted out to late fellow citizens shopkeepers Mr.Jayaraj and Mr.Bennix Emmanuel at Sathankulam in Tamil Nadu.
There are several eyewitnesses accusing the police inspectors of brutalizing the father and son. While there are reports mentioning the suspension of the concerned officers Mr. Balakrishnan and Mr. Pauldurai under Section 10-19 of the Tamil Nadu Police (Reforms) Act, 2013, please note that this is not enough. The officers must be held accountable for their gross misuse of power and must be charged for the brutal assault of the two men and the sexual misconduct committed against Mr. Bennix in custody.
1731 people in custody have died in the last year alone. It is necessary to acknowledge that systemic reforms are the need of the hour in order to tackle police brutality, as this is clearly not an isolated incident.
In order to ensure that this the last of such incidents, the Trader union bodies, various political outfits, activists, and the public at large have the following demands that must be met by the state and its officials:
1. Presence of an impartial doctor at the autopsy
2. Mandatory installation of CCTV surveillance in every police unit across the country
3. A mandate for all states to invest in sensitivity training programmes for all serving on the force.
India continues to be one of the few countries that hasn't yet ratified the United Nations Convention against Torture (UNCAT). There is no better time than now for the state to ratify it for it is extremely imperative in order to address the issues of brutality we are facing throughout the country.
Yours Sincerely,
To HRD, Ministry Of Minority Affairs, National Human Rights Commission, Edappadi K. Palaniswami TN CM, M.K. Stalin Leader of opposition in the TN Legislative Assembly, K.
